1. Definitions
In these terms and conditions the following terms shall have the following
Meanings :-
‘We, Us, Our’ – Shaukat
‘You, Your’ – The customer/consumer
‘Contract’ – A contract for the sale of goods by us to you.
‘Goods’ – Any goods forming the subject of a contract including parts of, or materials incorporated in, them as more particularly described upon this website.

3. Price
3.1 The price of the goods is set out on the website and on the confirmation of order. The price is in GBP (Britain Pounds) and excludes all taxes or other duties due, including Value Added Tax (VAT). This will be charged at the rate or rates applicable at the date of confirmation of the order. The Value Added Tax (VAT) will not apply to deliveries outside the UK.
3.2 Delivery charges are not included in the price of the goods. All delivery charges will be calculated on the total weight of the goods sent. The exact delivery charges will be calculated automatically once the order has been placed and the delivery address has been detailed. These charges will be clearly detailed at the bottom of your order form.
IMPORTANT Any orders placed with Shaukat Fabrics will be converted from GBP (British Pounds) into your currency by your credit card company when they process the transaction. Please remember that currency rates change all the time. The online currency conversion rate displayed on our website may differ to the rate charged when your transaction is processed by your credit card company.
4. Completing the Contract
4.1 When you complete your details, and the details of the goods which you wish to purchase, and then subsequently submit them to us by clicking the confirm order button, you are offering to purchase the goods at the price shown on the website subject to the terms and conditions stated.
4.2 The contract for the sale by us to you of the goods is completed when we send you the confirmation of order by email.
4.3 In order to buy goods from us through this website you must be at least 18 years old. We reserve the right at our discretion to refuse to complete a contract for the sale of goods to you.
5. Title
5.1 Risk in the goods shall pass to the customer on shipping, and until this point the customer shall keep the company indemnified against all loss or damage to the goods or depreciation in their value and shall keep them fully insured, and shall not remove the goods or allow them to be removed from the address to which they are delivered, and shall keep them in good condition, and shall not allow them to become the subject of any charge or lien, whether by operation of law or otherwise.
5.2 Notwithstanding the earlier passing of risk, title in the goods shall remain with the company and shall not pass to the customer until the amount due under the invoice for them (including interest and costs) has been paid in full.
6. Duties & Taxes
Any duties or taxes payable on purchase of Shaukat Fabrics products are the sole responsibility of the purchaser. If the purchaser refuses to pay the duties/tax it is then the responsibility of the purchaser to pay all shipping costs for the return of the item(s).
7. Payment
Payments made online by card are highly secure, as well as being convenient. However, if you prefer, we are pleased to accept orders by post, accompanied by a cheque.
IMPORTANT:
We use payment gateway system to credit check the buyers and if the credit check is successful, the amount of payment will be debited to the nominated credit card and the goods will then be dispatched.

10 Claims
10.1 You should examine the goods upon your receipt of them. If the goods are faulty or damaged you must notify us in writing at the contact address in clause 2, within three working days of your receipt of the goods. We will then, as appropriate, return the goods or deliver replacement goods to you.
IMPORTANT NOTICE:
a) Upon receipt of fabric, please examine the fabric and prior to cutting, ensure you are happy with the fabric since no responsibility is taken once a fabric has been cut.
b) Some fabrics may shrink during washing, dry cleaning, ironing, etc.
c) Shades can also vary from what it is shown on our website due to lighting within certain rooms.
d) Some fabrics may carry flaws, fault, Bari marks, 5% must be allowed.
11. Extent of Liability
11.1 We make every effort to ensure that goods advertised for sale on the website are described accurately. However, the descriptions of goods on the website do not form part of the contract between you and us. They are designed to represent a general idea of the goods. You should ensure that the goods which you are purchasing from us are suitable for your intended purpose. We do not give any warranty that the goods, which you purchase from us, are suitable for your intended purpose.
11.2 We will not be liable to you for any loss or damage which you suffer as a result of any breach by us of this contract, including, but not limited to, consequential loss to you and/or loss or damage to the property of third parties. In any event, our liability to you arising directly from our negligence will not exceed the invoice value of the goods. Nothing in this clause will limit our liability for death or personal injury resulting from our negligence. This clause does not affect your statutory rights.
11.3 We make every effort to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any website accessible through it will not cause damage to your computer. It is your responsibility to provide adequate protection for your equipment which you use to access this website. We will not be liable to you or to anyone else for any loss or damage which may be caused to any equipment arising as a result of your use of this website.
12. Law and Jurisdiction
The contract shall be governed by English law and we and you consent to the exclusive jurisdiction of the courts of England and Wales. If you access the website from locations outside of England and Wales you are responsible for complying with any laws applicable to that territory.
Fabric Length Minimums
The minimum length for all fabrics sold online are 0.5 meter.
